Terms and conditions
We mainly work for companies and organisations, and sometimes for private individuals. Where something different applies to consumers, we say so clearly.

1Who are we?
Think Nova NV (trading under the brand name Wakaaro)
Registered office: Brouwerijstraat 26A, 9880 Aalter, Belgium
Company and VAT number: BE 0870.459.687
Email: [email protected] · Phone: +32 9 375 68 00
2Scope
These terms apply to every quotation, order, booking and agreement between Think Nova NV (hereinafter "Wakaaro", "we") and the customer. The customer's own terms only apply if we accept them in writing.
A consumer is a natural person who buys for purposes outside their trade, business or profession. Consumers always benefit from the mandatory rules of Belgian consumer law, even if an article below says otherwise.
3Offers and prices
Our quotations are valid for 30 days unless another term is stated. Prices are in euros. For companies we state prices excluding VAT, for consumers including VAT. Shipping costs are shown separately before you confirm your order.
Prices on the website may change. For a confirmed order or accepted quotation, the agreed price remains valid. Obvious errors in prices or descriptions do not bind us.
4Orders and agreement
An order via the website is concluded as soon as you receive the confirmation email. For a quotation, the agreement is concluded when you accept it in writing (an email is sufficient).
A booking (for example for Missie Sustaire, a workshop or a session) is a request at first. It only becomes final once we confirm it by email.
5Payment
If you order online, you pay in advance via our payment partner Mollie. We do not see or store any card or bank details. Invoices are payable within 30 days of the invoice date, unless agreed otherwise.
Companies: in the event of late payment, the outstanding amount is increased by operation of law and without notice of default by a fixed compensation of 10%, with a minimum of €40, and by late payment interest in accordance with the Belgian Act of 2 August 2002 on combating late payment in commercial transactions. If an invoice remains unpaid, we may suspend further deliveries.
Consumers: you first receive a free reminder with a period of at least 14 days to pay. Only after that can interest and compensation be charged, within the limits of Book XIX of the Belgian Code of Economic Law.
6Delivery and risk
We deliver in Belgium and, on request, in other countries. Shipping costs are borne by the buyer. Delivery times are estimates. For companies, a delay does not entitle them to compensation or termination.
Consumers receive their order within 30 days at the latest, unless agreed otherwise. If we do not deliver on time, you can give us a reasonable additional period and then cancel the purchase.
For companies, the risk passes when we hand the goods to the carrier. For consumers, the risk passes when you (or someone you designate) receive the goods.
7Retention of title
Delivered goods remain our property until the full price has been paid. Until then, the customer may not transfer them to third parties.
8Complaints and warranty
Please check your order on receipt. Companies must report visible defects, wrong quantities or invoice errors in writing within 7 days of receipt via [email protected]. After that, the delivery is deemed accepted.
Consumers benefit from the statutory 2-year warranty on goods that do not conform. Please report a defect within 2 months of discovering it.
9Right of withdrawal (consumers only)
If you buy as a consumer at a distance (for example via our website), you may withdraw from the purchase within 14 days without giving a reason. This period starts the day after you receive the goods.
How it works:
- Let us know within those 14 days that you are withdrawing, via [email protected]. You may use the model form below, but you do not have to.
- Return the goods within 14 days after that to Think Nova NV, Brouwerijstraat 26A, 9880 Aalter, Belgium. The cost and risk of returning them are yours.
- Return the goods complete, undamaged and in their original packaging. You are responsible for any loss in value caused by handling beyond what is needed to examine the product, as you would in a shop. Cards and game materials come in sealed packaging: breaking that seal, or copying, photographing or scanning game materials, goes beyond examining the product, and we may charge the loss in value, up to the full price.
- We refund the purchase price, including the original standard shipping costs, within 14 days of receiving the return parcel (or proof that you sent it), using the same payment method. Any loss in value is deducted.
No right of withdrawal for:
- goods or services made to measure or personalised, such as personalised game sets and bespoke games;
- digital products (such as licences, credits or access to an online game) once you have used them. Unused digital products can be refunded within 14 days of purchase;
- services on a fixed date, such as a booking for Missie Sustaire, a workshop or a facilitated session. The cancellation terms apply to these.
Model withdrawal form
To Think Nova NV (Wakaaro), Brouwerijstraat 26A, 9880 Aalter, Belgium, [email protected]:
I hereby give notice that I withdraw from my contract for the sale of the following goods: [description]
Ordered on / received on: [date]
Name: [name]
Address: [address]
Date and signature (only for a paper form)
10Returns for companies
Companies and organisations have no right of withdrawal. An order can only be returned with our prior written consent, and only under these conditions:
- you request it within 14 days of delivery, via [email protected];
- the goods are unused, complete and still in their unopened, undamaged original packaging, with the seal intact;
- the shipping costs and risk of the return are borne by the customer.
We do not take back opened game sets, goods made to measure or with your own logo or house style, or used digital products. After receipt and inspection, we refund the purchase price (excluding shipping costs) within 14 days.
11Bookings, sessions and workshops
A booking is final once we confirm it by email. Please arrive at the agreed time. If a group arrives (very) late, we may shorten the session, without a discount. Participants follow the safety instructions of our facilitators. The customer is liable for damage that participants cause to the material or the room intentionally or through clear misuse.
You can reduce the number of participants free of charge up to 7 days before the session. After that, we charge the number of participants stated in the confirmation.
12Cancelling or rescheduling
Please cancel or reschedule in writing via [email protected]. The date on which we receive your message counts.
If you cancel, we charge part of the agreed price, because we kept that date free for you and already prepared:
- more than 30 days before the session: free of charge;
- 30 to 8 days before the session: 50% of the price;
- 7 days or less before the session: 75% of the price;
- no-show without notice: 100% of the price.
Rescheduling is free once, up to 14 days before the session, if the new date falls within 3 months. Rescheduling later counts as a cancellation.
If we have to cancel, for example because the facilitator is ill or due to another form of force majeure, we let you know as soon as possible and look for an alternative together: a new date or another facilitator. If that is not possible, we refund what you already paid. No further compensation is due in that case. If we cancel a consumer's session without force majeure, we refund the amount paid plus compensation equal to what you would have had to pay in the same situation.
Bespoke projects: if the customer stops an ongoing assignment, they pay for the work already done, the costs already incurred, and 25% of the part of the assignment not yet performed.
13Digital products and subscriptions
With a digital product (such as a licence for Sustainable Consumption or credits for the digital SDGame), you receive a personal, non-transferable right of use for the agreed period and number of users.
A subscription runs for the period stated at purchase, by default one year. If it renews automatically, this is clearly stated at purchase and we send a reminder beforehand. You can cancel up to one month before the renewal date via [email protected].
14Intellectual property
Everything Wakaaro creates or uses remains the property of Think Nova NV: games, game concepts and game mechanics, cases, scenarios, questions and solutions, cards, game boards, software, designs, texts, images, manuals and documentation. This also applies when we developed something specifically for the customer and the customer paid for it. Rights are only transferred if we expressly agree so in writing. The names and logos Wakaaro, SDGame, Missie Sustaire and Working Capital Challenge are our trademarks.
The customer receives a limited, non-exclusive and non-transferable right of use, solely for its own internal use and for the agreed purposes. Without our prior written consent, it is prohibited to:
- copy, scan, photograph or film (parts of) our products or projects in order to distribute, digitise or reproduce them;
- modify or translate them, or use them as the basis for your own game, training or product;
- sell, rent or lend them for a fee;
- use them in training courses, workshops or sessions the customer itself provides to third parties for a fee (our licences and Train-the-Trainer programme exist for this);
- use them to train artificial intelligence software or systems, or reverse engineer them.
The cases, solutions and game mechanics are confidential. Participants and customers do not share them, not even after the session.
In the event of an infringement by a company or organisation, a fixed compensation of €5,000 per infringement is due by operation of law, or five times the price of the product or project concerned if that is higher, without prejudice to our right to prove greater damage and to have the infringement stopped.
Content supplied by the customer (texts, images, logos, company data) remains the customer's property. We may use it to carry out the project. The customer guarantees that they hold the rights to that content and indemnifies us against claims by third parties.
We may reuse the game mechanics, code and structures we develop with other content, for other customers or our own projects. We never use the customer's confidential information for others. We may mention the customer's name and logo as a reference, unless the customer refuses in writing.
15Liability
We work with care and do everything we can to avoid mistakes. Nevertheless, the following applies.
Content of our games. Our games, cases, figures, scenarios and other content are meant for learning and practice. They simplify reality and are not financial, legal, tax, sustainability or any other professional advice. We do not guarantee that the content is complete, error-free or up to date. Decisions that the customer or participants make based on a game or its content are made at their own risk. We are not liable for any damage or losses resulting from them, not even if the content contains an error. The customer is responsible for content it supplied itself.
Companies. Our liability is in any case limited to the amount (excluding VAT) of the order or assignment concerned. We are not liable for indirect damage, such as loss of profit, lost savings, loss of data, loss of customers or reputational damage. A claim must reach us in writing within 6 months after the customer discovered the damage. These limitations do not apply in the event of intent or fraud.
Consumers. We are liable in accordance with the law, within the limits the law allows.
Always. We are not liable for damage caused by use contrary to the rules of the game, our instructions or the normal purpose of the product, nor for temporary unavailability of digital products or the website. Nothing in these terms limits our liability for damage that the law does not allow to be excluded, such as physical injury caused by our own fault.
16Force majeure
Force majeure is any circumstance beyond our control that prevents or seriously hinders performance, such as illness or an accident of the facilitator, strikes, disruptions at suppliers or carriers, outages of digital services, extreme weather or government measures. In the event of force majeure, we may postpone performance and we look for an alternative together. If the force majeure lasts longer than 2 months, either party may terminate the agreement free of charge. Anything already paid for what was not performed will be refunded. No further compensation is due.
17Personal data
How we handle personal data is explained in our privacy policy.
18Applicable law and disputes
Our agreements are governed by Belgian law. We prefer to solve any problem together: email us at [email protected].
If that does not work, disputes with companies fall under the exclusive jurisdiction of the courts of the judicial district of East Flanders, Ghent division. Consumers keep the right to go to the court of their place of residence, and can also contact the Belgian Consumer Ombudsman Service.
If a provision of these terms is invalid, the other provisions remain in force.
